Fisher obtained the first ruling
by a New York court to refer directly to the New York Court of Appeals’ watershed
decision in Hernandez v. Robles, 2006 WL 1835429. In that case, the Court
of Appeals found that laws enacted over the past 100 years evinced intent
by the Legislature to limit marriage to a union between a man and a woman.
Funderburke v. Uniondale U.F.S.D. was decided several weeks later by
the Nassau County Supreme Court. The Supreme Court in Funderburke denied
summary judgment motion to a retired Uniondale School District teacher
seeking to obtain spousal benefits for his same sex spouse, whom he had
married in Ontario, Canada in 2004. Scott represented the Uniondale U.F.S.D. |
